FOLIO n’ CO. TERMS AND CONDITIONS:


  1. INTRODUCTION:


Welcome to www.folionco.com (the "Website" or "Site"), operated by Folio n’ Co. SARL, a company registered in Jbeil, Lebanon, with its principal office located in Hosrayel, Jbeil. These Terms and Conditions ("Terms") apply to all visitors, users, and customers of the Website. By accessing or using the Site, you agree to comply with and be bound by these Terms, including our Privacy Policy. If you do not agree with any of these provisions, please do not use our website or place any order.

These Terms constitute a legally binding agreement between you (hereinafter, "you" or "your") and Folio n’ Co ("Folio n’ Co.", "we", "our", or "us").

We reserve the right to revise or update these Terms at any time without prior notice. Your continued use of the Website after such changes implies acceptance of the revised Terms.

  1. DISPUTE RESOLUTION
    If any controversy or claim arises in connection with these Terms or the use of our Website, we encourage parties to first attempt to resolve the matter amicably through direct negotiation.

If a resolution cannot be reached within thirty (30) days, the parties agree to submit the dispute to mediation under Lebanese law. If mediation fails, the dispute shall be resolved exclusively by the courts of Beirut, Lebanon, unless otherwise mutually agreed in writing.

You agree that any dispute must be brought individually, and not as part of any class action or collective proceeding.


  1. USE OF OUR WEBSITE
    By using the Website, you agree that:
    1. You are at least 18 years old and legally capable of entering binding contracts.
    2. You may only use the Website to make legitimate purchases or inquiries.
    3. You will not submit any false, misleading, or fraudulent orders.
    4. You will provide accurate and complete contact and billing information.
    5. You will not misuse the Website by introducing viruses or engaging in other malicious activities.
    6. You will not attempt unauthorized access to our servers or interfere with the security of the Website. We reserve the right to cancel any order and block access to any user who breaches these Terms.


  1. SERVICE AVAILABILITY
    Products displayed on the Website are available for delivery only within Lebanon. We currently do not offer international shipping. If a product becomes unavailable after placing an order, we will contact you with options for substitution or refund.


  1. HOW PURCHASE CONTRACTS ARE FORMED
    To place an order, you must complete the checkout process online and confirm payment. Upon placing your order, you will receive an acknowledgment email ("Order Confirmation"). This does not confirm acceptance of your order.

Your order constitutes your offer to purchase a product from us. The contract between you and Folio n’ Co. is formed when we dispatch the item(s) and send you a confirmation email ("Shipment Confirmation"). Only products confirmed in the Shipment Confirmation are included in the contract.

All receipts and confirmations are provided electronically via email. No paper invoices are issued.


  1. Eligibility for Loyalty Program
    To benefit from the Folio n’ Co. Loyalty Program and collect reward points, you must create an account on our website and complete your order while signed in. Orders placed via WhatsApp do not qualify for reward points or other loyalty benefits. While you may still place orders through WhatsApp for convenience, such orders are considered guest purchases and are not eligible for loyalty rewards.


  1. RISK AND TITLE
    All risks related to the products become your responsibility upon delivery. Ownership of the product(s) will pass to you only once we have received full payment, including applicable delivery fees.



  1. BUYING AS A GUEST
    While orders can be placed through WhatsApp, they are considered guest checkouts. These orders do not grant access to the Loyalty Program, return, or any related benefits. For full benefits and points collection, you must place orders through a registered account on the Website.


  1. EXPRESS CHECKOUT & DATA SECURITY
    Folio n’ Co. does not store your credit or debit card information on its servers. All payment data is securely handled by our third-party payment processor in compliance with PCI-DSS standards. With your consent, these processors may store your card in tokenized form to enable faster checkout in the future.



  1. PRICE AND PAYMENT
    All product prices are listed in USD and are exclusive of delivery charges. The final amount includes product total, delivery fees (if applicable), and any taxes required by Lebanese law.

Accepted payment methods include:
- Cash on Delivery (COD)
- Credit/Debit Card
- Whish Pay/ OMT Pay

Prices are subject to change without prior notice. In the event of a pricing error, you will be contacted to confirm the correct price before proceeding. If we are unable to reach you, the order will be canceled, and any paid amount will be refunded.


  1. DEFECTIVE PRODUCTS
    If you receive an item that is defective, please contact us within 48 hours of receiving the item. Provide photos and a clear description. If validated, we will offer one of the following remedies at no additional charge: Full refund, A replacement of the defective item, or a store credit for future purchases.


  1. LIMITATION OF LIABILITY
    Folio n’ Co. is not liable for indirect, incidental, or consequential damages, including but not limited to loss of profit, business, or data.
    1. Our total liability for any purchase will not exceed the amount you paid for the product(s) in question.
    2. We are not responsible for delays or failures in performance resulting from causes beyond our control, including but not limited to natural disasters, internet failures, or government restrictions.


  1. INTELLECTUAL PROPERTY
    All content on the Website, including text, logos, images, design elements, and product photos, are the property of Folio n’ Co. or its licensed providers. You may not reproduce, distribute, or create derivative works without express written permission.


  1. THIRD-PARTY MATERIALS
    Folio n’ Co. may use licensed third-party assets (e.g., fonts, design templates) under proper usage rights. Ownership remains with the original creator and is acknowledged accordingly.



  1. INDEMNIFICATION
    You agree to indemnify and hold harmless Folio n’ Co. SARL and its affiliates from any claim, demand, or damage, including legal fees, arising out of your breach of these Terms or your violation of any rights of another.
  2. COMMUNICATIONS
    By using the Website, you consent to receive electronic communications from us. These may include order confirmations, updates, legal notices, and promotional offers. You may opt out of promotional emails at any time.


  1. ACCOUNT SECURITY
    You are responsible for maintaining the confidentiality of your account credentials. Folio n’ Co. will not be liable for any unauthorized access resulting from your failure to secure your login information.


  1. CUSTOMER SUBMISSIONS
    We currently do not accept or publish customer reviews, comments, or uploaded content on the Website. Any materials submitted to Folio n’ Co. via other channels (email, WhatsApp) may be used only with your prior consent.


  1. NOTICES
    Official notices will be sent to the email or address provided in your order. Notices are deemed delivered 24 hours after email dispatch or three days after postal mail is sent.


  1. ASSIGNMENT
    You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations at any time.


  1. FORCE MAJEURE
    We shall not be held liable for delays or failures in performance caused by circumstances beyond our control, including but not limited to strikes, natural disasters, government actions, or logistics disruptions.


  1. WAIVER
    Our failure to enforce any right under these Terms does not constitute a waiver of that right or any others.



  1. SEVERABILITY
    If any part of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.
  2. ENTIRE AGREEMENT
    These Terms, together with the Privacy Policy and any additional policies on the Website, constitute the entire agreement between you and Folio n’ Co. SARL.


  1. MODIFICATIONS
    We reserve the right to modify these Terms at any time. Continued use of the Website following such changes constitutes your agreement to the updated Terms.


  1. GOVERNING LAW
    These Terms shall be governed by and construed in accordance with the laws of Lebanon. Any dispute shall fall under the exclusive jurisdiction of the courts of Beirut, Lebanon.
